GDPR — RIGHTS OF EEA AND UK DATA SUBJECTS

This section applies to individuals located in the European Economic Area (EEA) or the United Kingdom (UK) whose personal data we process. OWTV.gg acts as the data controller for personal data collected through the Services. You can contact us regarding data protection matters at owtvgg@gmail.com.

The Services are hosted in the United Kingdom. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Services, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.

Lawful Basis for Processing. We process your personal data only where we have a lawful basis to do so. The bases we rely on are: (1) your consent, where you have given us clear consent to process your data for a specific purpose; (2) contract, where processing is necessary to perform our contract with you or to take steps at your request before entering into a contract; (3) legal obligation, where we must process your data to comply with a legal requirement; and (4) legitimate interests, where processing is necessary for our legitimate interests or those of a third party, provided those interests are not overridden by your rights and interests.

Your Data Subject Rights. Subject to applicable law, you have the following rights in relation to your personal data:

Right of Access. You have the right to request a copy of the personal data we hold about you and information about how we use it.

Right to Rectification. You have the right to request that we correct any personal data we hold about you that is inaccurate or incomplete.

Right to Erasure. You have the right to request that we delete your personal data where there is no compelling reason for us to continue processing it, subject to certain legal exceptions.

Right to Restriction of Processing. You have the right to request that we restrict the processing of your personal data in certain circumstances, for example while we verify the accuracy of data you have disputed.

Right to Data Portability. Where processing is based on your consent or on a contract, and is carried out by automated means, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, and to have it transmitted to another controller where technically feasible.

Right to Object. You have the right to object to processing based on our legitimate interests, and to processing for direct marketing purposes. Where you object to processing for direct marketing, we will cease that processing immediately.

Rights Related to Automated Decision-Making. You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal or similarly significant effects concerning you, unless such processing is necessary for a contract, authorised by applicable law, or based on your explicit consent.

Withdrawing Consent. Where we process your personal data on the basis of your consent, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Data Retention. We retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected, including to satisfy any legal, accounting, or reporting obligations. Where we have no ongoing legitimate business need to process your personal data, we will delete or anonymise it.

International Data Transfers. For transfers of personal data from the EEA to the UK, we rely on the UK Adequacy Decision adopted by the European Commission. For any other international transfers, we ensure appropriate safeguards are in place in accordance with applicable data protection law, such as standard contractual clauses approved by the relevant supervisory authority.

Right to Lodge a Complaint. You have the right to lodge a complaint with the relevant supervisory authority if you believe our processing of your personal data infringes applicable data protection law. In the UK, the relevant authority is the Information Commissioner's Office (ICO), which can be contacted at ico.org.uk. If you are based in the EEA, you may contact the supervisory authority in your country of residence.
